Home Country Tax on Cambodian Property: 2026 Guide
Home country tax for Cambodia property owners 2026: US, UK, EU, Australian reporting basics, foreign rental income, CGT overlap, and adviser triggers.
Quick answer: Cambodia property does not exempt foreign owners from home-country tax reporting. US persons face FBAR and Form 8938 thresholds plus rental Schedule E. UK, EU, and Australian residents typically declare foreign rental and future disposal gains under local rules. Cambodia capital gains tax on property from 1 January 2027 adds another layer on sale. Always use a cross-border tax adviser, not a blog summary.

What does Cambodia tax before your home country sees anything?
| Event | Cambodia trigger | Home country trigger |
|---|---|---|
| Rental receipt | Local filing may apply | Foreign income reporting |
| Purchase | Stamp duty | Some jurisdictions wealth reporting |
| Sale 2027 plus | CGT Cambodia | Capital gains at home |
| Wire transfers | Bank reporting | FBAR / FATCA style rules |
What do US persons have to file on a Cambodian condo?
US persons are taxed on worldwide income, so Cambodian rent is reportable whether or not it is remitted. Report foreign accounts if the aggregate exceeds the FBAR threshold, and file Form 8938 where the higher asset tests apply. Rental income goes on Schedule E, converted to dollars at the IRS rate, which is straightforward here because Cambodia already transacts in dollars.
| Item | Where it lands |
|---|---|
| Cambodian rental income | Schedule E, worldwide income basis |
| The 14% Cambodian withholding | Foreign tax credit, subject to limitation |
| Cambodian bank accounts | FBAR if the aggregate threshold is exceeded |
| Larger foreign asset holdings | Form 8938 where the tests apply |
| Sale from 1 January 2027 | Cambodian 20% CGT plus US capital gains treatment |
- PFIC and foreign trust rules rarely reach a directly held condo, but a structure changes that.
- Holding through a Cambodian company is where US reporting gets materially harder.
- Keep the Cambodian withholding certificates; the credit depends on them.
- Confirm the position with a CPA rather than with a Cambodian agent.
How do UK and EU residents report Cambodian rent?
UK residents declare foreign property income through self-assessment, and EU residents through the local equivalent return. Principal private residence relief does not cover an investment unit in Phnom Penh, and the UK has no double taxation agreement with Cambodia, so relief for the 14% withheld runs through unilateral credit rules rather than a treaty.
| Question | UK position |
|---|---|
| Is Cambodian rent reportable | Yes, on self-assessment as foreign property income |
| Treaty with Cambodia | None in force |
| Relief for the 14% | Unilateral foreign tax credit, subject to HMRC rules |
| Principal private residence relief | Not available on an investment unit |
| Records to keep | Withholding certificates and manager statements |
- EU treatment varies by member state; check the local foreign income rules.
- The absence of a UK treaty puts British buyers in the same position as Japanese ones.
- The British market has its own page in the British buyers guide.
How do Australian and Singaporean residents treat it?
Australian residents include net rent after expenses in the foreign income schedules and can generally claim a foreign income tax offset for the 14% withheld. Singapore taxes on a remittance basis for foreign-sourced income, and has a Cambodian agreement in force, which usually makes it one of the cleaner positions in this list.
| Jurisdiction | Basis | Treaty with Cambodia |
|---|---|---|
| Australia | Worldwide, net rent after expenses | None in force |
| Singapore | Foreign-sourced income rules, remittance sensitive | In force |
| Malaysia | Resident exemption to 31 December 2036 | In force |
| Hong Kong SAR | Territorial | In force |
- Australian buyers have their own page in the Australian buyers guide.
- Singaporean buyers are covered in the Singapore buyers guide.
- Malaysian treatment is worked through in the Malaysian buyers guide.
Which countries have a tax treaty with Cambodia?
Cambodia has 13 double taxation agreements signed and 11 in force. The network covers Singapore, China, Thailand, Brunei, Vietnam, Indonesia, Malaysia, South Korea, Hong Kong SAR, Macau SAR and Turkey, with Laos and the Philippines signed and pending. Most of these agreements cut Cambodian withholding on dividends, interest, royalties and technical service fees from 14% to 10%.
| Market | Agreement status | What it changes for an owner |
|---|---|---|
| Singapore, Vietnam, Malaysia, Thailand, Indonesia, Brunei | In force | Relief by credit at home; 10% on dividends, interest, royalties, service fees |
| China, South Korea, Hong Kong SAR, Macau SAR, Turkey | In force | Same treaty mechanics; home treatment differs by jurisdiction |
| Laos, Philippines | Signed, pending | No relief until entry into force |
| Japan | In negotiation, none in force | Unilateral foreign tax credit only |
| Taiwan | None | Domestic Taiwanese rules only |
| United Arab Emirates | Not signed, reported about 96% negotiated | No treaty relief available yet |
The point almost every buyer gets wrong. A tax treaty does not reduce the 14% Cambodian withholding on rental income. Income from immovable property is taxable in the country where the property sits, with no treaty cap, under Article 6 of the model convention and the corresponding article in each of Cambodia’s agreements. The 10% treaty rate belongs to the dividends, interest and royalties articles, which is why a treaty is valuable to someone holding through a company and close to irrelevant to an individual collecting rent on a condo.
- The 14% on rent applies identically to treaty and non-treaty nationalities.
- What a treaty changes is relief at home, plus withholding on company-level flows.
- Relief at home is normally by credit, which requires Cambodian tax receipts.
- Keep every withholding certificate; it is the evidence for the credit or exemption.
- Anyone quoting 10% on rent should be asked to name the treaty article.
Five markets now have their own page working the position through end to end: Japanese buyers, where no treaty exists at all; Vietnamese buyers, where two separate outbound regimes decide how the money leaves; Malaysian buyers, where the foreign-sourced income exemption runs to 31 December 2036; Taiwan and Hong Kong buyers, which diverge sharply from each other and from the mainland; and Gulf and UAE buyers, where 0% home tax means there is nothing to credit the Cambodian charge against.

What should you verify with your own tax adviser?
Five questions decide the outcome and none of them can be answered by a Cambodian agent. Ownership form, remittance basis, the timing of a sale against the Cambodian 20% capital gains charge starting 1 January 2027, the availability of a credit or exemption for the 14% withheld, and estate treatment on death.
| Question for your adviser | Why it matters |
|---|---|
| Do I hold personally or through an entity? | Changes reporting, and in some jurisdictions triggers CFC rules |
| Is my home country worldwide or remittance based? | Decides whether unremitted rent is taxable at all |
| Can I credit or exempt the 14% Cambodian withholding? | Decides the total burden, not just the Cambodian one |
| Does my exit cross 1 January 2027? | Cambodia charges 20% of the gain from that date |
| What happens to the unit on death? | Cambodian and home estate rules both apply |
Take the answers in that order rather than starting with the yield. A buyer who establishes ownership form and relief mechanism first can compare buildings on a genuinely net basis, while a buyer who picks the building first is committed before the tax position is known. Estate treatment is covered separately in the inheritance guide, and the Cambodian gain charge in the CGT guide.
Risks, red flags, and what to verify
- Assuming a treaty exists: Cambodia has agreements with a limited set of countries, and several major buyer markets are not among them.
- Ignoring rental tax at source: non-resident rental income is taxed in Cambodia before your home country looks at it.
- Missing the credit mechanics: relief usually comes as a credit, which requires documentation you must collect at the time, not later.
- Forgetting the reporting threshold: transfers at or above $100,000 are reported, and a surprise on that side is avoidable.
- Planning the exit in one jurisdiction only: the Cambodian capital gains regime from 2027 and your home rules both apply to the same sale.
Advantages and disadvantages
| Advantages | Disadvantages |
|---|---|
| USD-priced Phnom Penh stock | 76,000 to 80,000 units caps rent growth |

What does a complete diligence file look like?
Our own diligence set for a Cambodian purchase runs to three files, and the order matters more than the volume. First, the sale agreement with its payment exhibit attached, so the instalment ladder is visible rather than described. Second, written confirmation of the building’s remaining foreign quota, expressed as a share of total private-unit area and dated within 30 days, because a figure from last quarter is not a figure. Third, at least three rent comparables from the same building or an adjacent tower of the same class. On resale we add a lawyer’s trust letter naming the beneficiary before any deposit moves. Net yield worksheets then subtract 8% to 12% management, one to two months of vacancy, the monthly service charge at about $1.50 per sqm, the sinking fund line and a tax provision, because a brochure quoting 12% to 15% gross is quoting a number nobody collects.

Which markets have no agreement at all?
Three of the larger sources of foreign buyers into Cambodia, and buyers from them often assume otherwise. Cambodia has 13 agreements signed and 11 in force, covering Singapore, China, Thailand, Brunei, Vietnam, Indonesia, Malaysia, South Korea, Hong Kong SAR, Macau SAR and Turkey.
| Market | Position |
|---|---|
| Japan | No agreement in force; negotiation reported |
| Taiwan | No agreement |
| United Arab Emirates | Not signed; negotiations reported about 96% complete |
| Laos and the Philippines | Signed, pending entry into force |
| United Kingdom | No comprehensive agreement |
| Poland | No comprehensive agreement |
Our analysis stresses that the absence of an agreement changes less than buyers fear, because most home countries grant a unilateral credit for foreign tax paid regardless of treaty status. What the absence removes is the reduction from 14% to 10% on the passive-income categories, and that reduction never applied to rent in the first place under Article 6.
- No treaty usually means no reduction, not no relief.
- Rent was never covered by the reduction, treaty or not.
- Rate detail sits in the rental income tax guide.
- Repatriation is in the repatriation guide.
- The 2027 charge is in the capital gains tax guide.
What should you keep for your home-country return?
Six documents, kept from the first month rather than assembled at year end. Most home tax authorities want evidence that foreign tax was actually paid, not merely that it was deducted.
| Document | Why the home authority wants it |
|---|---|
| Tenancy agreement | Establishes the rent contracted |
| Bank credits showing rent received | Establishes what was actually collected |
| Cambodian withholding remittance confirmations | Evidences tax paid, not just deducted |
| Management invoices | Supports any expense claimed |
| Annual property tax receipt | A deductible cost in many systems |
| Exchange rate used for conversion | Home authorities usually specify a basis |
Our analysis stresses the third row, because a credit for foreign tax generally requires proof of payment and a deduction on a rent statement is not that. Where a managing agent handles remittance, ask for the confirmation each month rather than at year end, since agents change and archives do not always follow.
- A credit at home needs proof the tax was paid, not deducted.
- Collect remittance confirmations monthly, not annually.
- Cambodian rates sit in the rental income tax guide.
- Management arrangements are in the property management guide.
- Repatriation is in the repatriation guide.
