Russian Buyers in Cambodia: The Wire Is the Obstacle

The Cambodian law is open and there is no tax treaty. For most Russian buyers the binding constraint is neither: it is getting a bank to move the money.

View in Cambodia

Quick answer: Cambodian law is open to Russian buyers on exactly the same terms as anyone else, and there is no Russia-Cambodia tax treaty. Neither fact is usually what decides the purchase. The decisive question is practical: can the purchase money reach a Phnom Penh account through a route the receiving bank will accept, with a payer name that matches the buyer on the contract.

Guides written for Russian buyers usually describe Cambodian ownership rules, which are identical for a Frenchman. The Russian-specific material is upstream of the property entirely, in the mechanics of settlement, and it deserves to be settled before a reservation is signed rather than after.

Where the difficulty actually sits

For most nationalities on this site the home-country complication is a tax filing. Here it is the payment rail, and no Cambodian agent can resolve it because none of it happens in Cambodia.

Our read is that this ordering is what Russian-language marketing for this market most often inverts. The showroom conversation covers the unit, the yield and the payment plan and stops at the point where dollars have to arrive, which is the only part that is genuinely uncertain. A buyer who signs a reservation before establishing the route has committed to a schedule they may be unable to meet, and the deposit is the first thing exposed when a transfer is delayed, returned or rejected. Establishing the route first costs nothing and changes the order of risk entirely.

The Cambodian rules that apply to everyone are in can foreigners buy property in Cambodia, and the mechanics of paying a Cambodian seller, what the receiving bank asks for and how long it takes, are in the bank wire transfer guide.

What a receiving bank actually requires

Cambodian banks apply compliance procedures to inbound funds like banks anywhere, and the requirements are documentary rather than discretionary. Knowing them in advance is most of the work.

RequirementWhy it matters
Source of funds evidenceStandard for a large inbound transfer
Stated purposeProperty purchase, matched to a contract
Payer name matching the buyerThe point on which files most often fail
Sale agreementSupports the purpose
Correspondent routeDetermines whether the transfer clears at all
TimingCompliance review takes time; plan the schedule around it

Insider tip: agree with the seller or developer, in writing and before signing, what happens if a transfer is delayed in compliance review rather than refused, a deposit forfeited because a wire took three weeks instead of three days is a contractual problem, not a banking one, and it is entirely preventable with one clause. Our reading of where buyers create lasting damage is the third-party payment. Faced with a blocked route, a buyer accepts an offer to have someone else remit on their behalf. Whatever that does elsewhere, in Cambodia it produces a file where the registered owner did not pay for the property, and that mismatch is discovered by the next buyer’s lawyer at resale. The unit becomes harder to sell than it was to buy, which is the worst outcome available in an illiquid market.

The standard purchase file and its sequence are set out in due diligence step by step; the patterns to refuse are catalogued in the property scam checklist.

The tax position, which is the simpler half

With no treaty, the two systems operate independently and relief depends on Russian domestic provisions.

ItemCambodiaRussia
Rent, non-resident owner14% withholding on Cambodian-source incomeWorldwide charge for tax residents
ReliefNot applicableDomestic rules; no treaty
Purchase4% transfer tax on assessed valueReporting obligations may apply
Holding0.1% annual property tax above thresholdForeign account reporting rules
Disposal20% capital gains from 1 January 2027Within the Russian charge for residents
EvidenceWithholding certificate, on requestNeeded to support any relief

What we could verify on the Cambodian side is documented across this site and is nationality-blind. The Russian side needs advice at home, and the practical instruction matches what this site gives German and Polish buyers for the same structural reason: where relief is unilateral rather than treaty-based, documentation carries more weight, because there is no agreed procedure to fall back on. Obtain Cambodian withholding evidence monthly from the managing agent, keep the assessed value and the transfer tax receipt, and record the date and amount of every transfer as it happens.

Cambodian income treatment is in rental income tax for foreign owners, and the cross-border comparison across nationalities in home-country tax for property owners.

Check the payment route

Sihanoukville, and why the discount is information

Russian-language marketing for Cambodian property has concentrated on the coast, where prices are lowest. That is also where this market’s clearest failures sit.

FeatureReality
Build cycleHeavy construction 2017-2019, much of it unfinished
Current stockStanding shells and completed towers side by side
PricingLow, and low for reasons
Resale liquidityThin; exits measured in many months
Banking backdropNon-performing loan ratio near 8.9%
Correct readingThe discount is a signal, not a bargain

Our analysis of the coastal market is the same one this site gives every nationality, because the risk is not national. A price well below Phnom Penh’s citywide average of roughly $1,800 per sqm is telling you what demand looks like, not offering you an inefficiency to exploit. The specific checks matter more here than anywhere: has this developer completed anything a buyer can visit; is the deposit protected under Prakas 047; what does the quota ledger say in square metres; and is the building occupied or merely finished. A buyer who cannot answer all four should look at completed Phnom Penh stock instead, where the evidence exists and the resale market, while not deep, is genuinely functional.

The coastal market’s condition is described in the Sihanoukville profile and the stalled-project pattern in the NPL and unfinished projects warning; counterparty checks are in developer due diligence red flags.

The honest summary

Nothing in Cambodian law stands between a Russian buyer and a Phnom Penh apartment, and nothing in the tax position is unusual for a country without a treaty. The work is in the settlement: establish a compliant route before committing to a schedule, insist that the payer and the registered owner are the same person, and build a delay clause into the contract. Do those three things and the purchase becomes an ordinary one, judged like any other on the title, the ledger, the developer and the fund.

After the purchase: holding it, and getting out

The settlement problem does not disappear once the unit is bought; it reappears in two milder forms, and both are easier to handle if they are anticipated.

The first is income. Rent arrives in dollars into a Cambodian account, and the same considerations that governed the inbound transfer apply in reverse when funds move out. Many owners simply accumulate rent locally and use it for service charges, taxes and periodic works, repatriating rarely and in planned amounts rather than monthly. That is usually the lower-friction pattern, and it has the side benefit of keeping a reserve where the bills actually arise.

The second is the exit. A sale produces a single large sum at the moment when the buyer, not the seller, controls the payment route, so a Russian owner selling to another foreign buyer inherits that buyer’s banking constraints. The practical protections are the ones any seller should want anyway: a written payment schedule, a deadline with consequences, and a willingness to consider buyers whose funds are already in the country. Cambodia’s 20% capital gains tax from 1 January 2027 applies to the gain itself, and the transfer-cost relief on the way in expires four weeks earlier, on 31 December 2026.

Neither of these is a reason to avoid the market. They are reasons to treat the payment rail as a permanent feature of the investment rather than a hurdle cleared once at the start.

What the Cambodian side asks of any buyer

It is worth closing on the part that is not Russian at all, because it is where the money is actually won or lost. Whatever the passport, this market rewards the same short list of checks and punishes their absence in the same way.

Verify the strata title and run an encumbrance search at the Land Office on the parcel rather than on a project name. Obtain the quota-headroom extract in square metres, dated, for the specific building. Read the co-ownership regulations and the sinking-fund statement together, since a fund that has collected for years without spending is describing deferred maintenance. Establish that the developer has completed something a buyer can visit, and visit it. And confirm the seller is the registered owner or holds a verifiable power of attorney.

This site’s own verification of the market found published pages describing buildings in the wrong district, under the wrong developer, and in a number of cases with no verifiable existence at all. Every one of those would have failed the checks above in an afternoon. A buyer who has solved the payment problem and then skipped the property problem has simply arrived at the wrong purchase more efficiently.

Frequently Asked Questions

Yes. Cambodian law does not restrict ownership by nationality: any foreign individual may hold a strata-titled unit above the ground floor, inside the cap of 70% of the building's total private-unit area. No Cambodian rule treats a Russian buyer differently.

No. Cambodia's roughly thirteen agreements are concentrated in Southeast and East Asia, and Russia is not among them. Relief for a Russian tax resident depends on domestic provisions rather than an agreed allocation of taxing rights.

The payment. Cambodian property transacts in US dollars, and dollar transfers clear correspondent banking with compliance checks throughout. The difficulty is usually not permission to buy but finding a route a Phnom Penh bank will accept without the funds being returned or held.

Source of funds evidence, the stated purpose of the transfer, and a payer whose name matches the buyer in the sale agreement. That last point is unforgiving: a third-party payment creates a defect that surfaces at resale, whatever the reason for it.

No. Beyond the compliance exposure, they break the payment trail a clean Cambodian title depends on: the record must show the registered owner paying for the property. A file that cannot show that is harder to sell than it was to buy.

It is where Russian-language marketing has been most active and where the market's clearest stalled construction sits. Cheap coastal stock from the 2017 to 2019 cycle is cheap for reasons a discount does not solve, and resale there is thin.
